Terms and Conditions

These Terms and Conditions ("Terms") govern the purchase and use of educational products ("Products") from Virtuous Education ("we," "us," "our"), an Australian business operating from New South Wales (ABN: 45 645 210 738). By purchasing, downloading, or using our Products, you ("Customer," "you") agree to be bound by these Terms.

1. About Our Products and Who They're For

Our Products are designed for use by high school-aged students, under the guidance of a parent, guardian, or teacher. They are supplied in two formats:

  • Digital units, workbooks, and related materials — our primary offering, available instantly to homeschooling families, individual educators, and the general public via our online store.

  • Physical, printed copies — offered to families from time to time as an alternative to digital files (availability varies by product), and supplied exclusively to schools as part of a School Partnership Agreement. We do not provide digital files to schools (see Section 2.1 and our School Collaboration page).

1.1 Purchaser eligibility: The person purchasing or holding an account ("Customer") must be at least 18 years old, or a school/institution acting through an authorised adult representative. Students may use the Products as directed by their parent, guardian, or teacher.

1.2 Changes to these Terms: We may update these Terms at any time. Changes take effect once posted on this page, and your continued use of our Products after that point constitutes acceptance.

2. Products and Licence

2.1 Format: Most Products are supplied as digital downloads. From time to time, we also offer physical, printed copies directly to families as an alternative. Schools licensing our curriculum receive physical, printed copies only — we do not supply digital files to schools, in order to protect the integrity of school licensing arrangements.

2.2 Licence granted: On purchase, we grant you a non-exclusive, non-transferable, non-sublicensable licence to use the Products for personal homeschooling or in-class teaching purposes, as set out in our Copyright & Permitted Use Policy.

2.3 You may: a. Download and use Products for your own household or classroom. b. Print copies for use within that household or classroom.

2.4 You may not: a. Share, resell, distribute, or transfer Products to third parties. b. Modify or create derivative works from Products. c. Use Products for commercial purposes without our prior written consent. d. Remove or alter copyright notices or watermarks.

3. Purchases and Payment

3.1 Pricing: Prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable, unless stated otherwise. Prices may change without notice; the price at the time of your order applies to that order.

3.2 Payment methods: We accept payment via PayPal and Stripe. Your payment is also subject to those providers' own terms.

3.3 Taxes: International customers are responsible for any local taxes, duties, or VAT applicable in their own jurisdiction.

4. Refunds and Returns

4.1 Digital products: Due to their nature, digital Products are non-refundable once accessed or downloaded, except where required under the Australian Consumer Law (ACL) or other applicable consumer protection law.

4.2 Physical/printed products: This applies whether your printed copy was purchased directly as a family/individual order, or supplied to a school under a School Partnership Agreement. We do not accept change-of-mind returns. If a printed item arrives faulty, damaged, or incorrect, contact us at info@virtuouseducation.com within 14 days of delivery with evidence of the issue, and we will arrange a replacement, exchange, or refund in line with the ACL. We do not cover return shipping for non-faulty items.

4.3 Your consumer guarantees: Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

5. Delivery and Access

5.1 Digital Products are delivered via a download link upon confirmed payment. You're responsible for downloading and securely storing your files.

5.2 Physical, printed copies — whether ordered by a family or supplied to a school — are shipped in line with our Shipping & Returns Policy, and (for schools) any timeframes agreed in your School Partnership Agreement.

5.3 If you experience a technical issue accessing your Product, contact info@virtuouseducation.com and we'll assist promptly.

5.4 We may suspend or revoke access to Products where these Terms have been breached.

6. Intellectual Property

We retain all ownership and intellectual property rights in our Products, including copyright, trademarks, and branding. Use beyond the licence granted in Section 2 — including reproduction, resale, or unauthorised distribution — is prohibited. Full terms are in our Copyright & Permitted Use Policy.

7. Acceptable Use

You agree not to use our website or Products to: act unlawfully; upload Products to public or shared online platforms (including learning management systems accessible beyond your own class) without our written consent; or interfere with the security or operation of our website.

8. Third-Party Services

Our website and checkout rely on third-party providers (including Squarespace, Stripe, and PayPal). We are not responsible for the availability or performance of these third-party services, which are governed by their own terms.

9. Warranties and Liability

9.1 We take care to ensure our Products are accurate and high quality but do not guarantee they are error-free or will meet every individual need.

9.2 Products are provided "as is," without warranties beyond those that cannot be excluded under the ACL.

9.3 To the maximum extent permitted by law, our total liability arising from your purchase or use of a Product is limited to the amount you paid for that Product. We are not liable for indirect, incidental, or consequential loss, including loss of data or anticipated outcomes.

10. Indemnity

You agree to indemnify Virtuous Education and its owners and staff against claims, losses, or liabilities arising from your misuse of the Products or breach of these Terms.

11. Force Majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including technical outages of third-party platforms we rely on.

12. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Disputes will first be addressed through good-faith discussion and, if unresolved, mediation in Sydney, Australia, before resort to the courts of New South Wales. International customers remain bound by these Terms and acknowledge their enforceability in their own jurisdiction, without limiting any local consumer protections that may also apply.

13. General

13.1 Entire agreement: These Terms (with our Privacy Policy and Copyright & Permitted Use Policy) constitute the entire agreement between you and us. 13.2 Severability: If any provision is found invalid, the remaining provisions continue in effect. 13.3 Waiver: Our failure to enforce a provision is not a waiver of it. 13.4 Assignment: You may not transfer your rights or obligations under these Terms without our written consent.
